Terms of Provision of Service

Terms

In this Contract, the "Provider" refers to the entity that issued the quotation, while the "Client" refers to the entity to whom the quotation is addressed.

The "Venue" refers to the locale as well as the management company for the location for the event which is specified on the quotation. 

1. Services Provided

The Provider offers to provide Event Services for the Client's event scheduled on the date and at the venue presented in the quotation. 

This Provision of Service Contract ("Contract") is entered into on the date the Client communicates its acceptance of the Provider’s offer and quotation.

2. Equipment Responsibility

Vendor

The Provider is responsible for ensuring that all Sound & Lighting equipment is in working order prior to the event.

Client

If any equipment is damaged by guests/Client during the event, the Client is responsible for the cost of replacing or repairing the damaged equipment.

3. Power Supply

Mains Power

The Provider assumes that a reliable power supply will be provided by the Client at the Venue.

Generator Backup

The Provider may offer a generator as a backup option, which is sourced externally. The Provider does not guarantee the generator's functionality.

4. Payment Terms

Due Dates

A non-refundable Deposit of 50% of the total fee is required to confirm the booking, payable:

  • no later than 36 hours before the event, ordinarily; EXCEPTING
  • no later than 7 days before performance, in the case of high demand periods, such as national holidays and local festivals.

The remaining balance is due upon completion of performance at the event and must be paid within 24 hours.

Exception: The occurrence of an Act of God prior to, and preventing conduct of, the event will exempt the Client from paying any further fees and costs.

The Client’s confirmation is tendered in payment of the service’s Deposit to the Provider.

The Provider confirms the agreed service upon acceptance of the Client’s Deposit payment.
No other verbal or written communication, whether stated by Client or Provider, may be construed as confirmation. 

5. Additional Performance Hours

If the event is billed at an hourly rate, any additional performance hours beyond the agreed time must be paid by the Client when settling the balance within 24 hours of the even

For events with a fixed price, any additional hours will be subject to national labour laws and will be billed at the agreed hourly rate or as otherwise specified.

6. Event Details

The Client will advise the Provider all details about the event's crowd (expected size, demographic, primary language and ethnicity) and the type of music expected to be played as well as the type and purpose of the event.

7. Role Clarification

Provider

The Provider primarily offers the services of a deejay and will not act as the event’s MC (Master of Ceremonies/ announcer) or event organizer unless previously agreed upon in writing.

8. Stand-In Provision

In case of any unavailability due to illness, family emergency or direct and unforeseen crisis,, the Provider reserves the right to send a stand-in Organiser/DJ/Crew Member at no additional cost.

9. Venue Access

The Client must provide the Provider with access to the venue for 24 hours before the event, during the event, and after the event for survey, setup, sound testing, and teardown.

10. Amenities

The following amenities are required for the Provider and any member of the event crew:

  1. Access to bathroom facilities at all times.
  2. A designated area for eating and resting.
  3. If not included in the quotation, food and drink should be provided within national labour laws and at standard meal times.
  4. Unless transportation is included in the quotation, the Client must provide transportation for the event crew.
  5. A working surface and seating must be provided for the DJ and event staff unless otherwise specified in the quotation. The Client is responsible for confirming whether the venue or the Client directly will provide these.

11. Governing Law

This Contract shall be governed by and construed in accordance with the laws of Mozambique.

12. Entire Agreement

This Contract constitutes the entire agreement between the parties and supercedes all prior agreements and understandings, whether written or oral, relating to the subject matter hereof.

13. Amendments

Any amendments to this Contract must be made in writing and signed by both parties.

14. Acceptance

By confirming any quotation and payment, the parties agree to the terms and conditions outlined in this Contract..
